RAMON TRILLO v ECOWAS - RULING
We are pleased to have represented the Economic Community of West African States (ECOWAS Commission) in a Contentious Litigation before the Federal Capital Territory High Court, Sitting in Abuja Nigeria Coram: Kutigi .J in suit No: FCT/CV/ 475/2018 in matter instituted by Spanish Attorney; Ramon Trillo Maquina claiming professional fees from his representation of the Commission in an LCIA Arbitration in London.
The court upheld the argument of our Lead Counsel M.J Numa Esq that unless expressly waived, the ECOWAS Commission is absolutely immune from National Court
proceedings irrespective of the nature of the dispute and that the forum was not convenient for the determination of the dispute.
This decision is a landmark decision as it tends to recognize the ECOWAS Community court of Justice as the appropriate forum for determination of disputes that concern the Commission at large and not National/Municipal Courts.
